Terms and Conditions

Art. 1 Scope These General Terms and Conditions (GTC) govern the use of the hypothek.ch platform as well as the use of the services of Swiss Mortgage Services AG (hereinafter "Operator").

Art. 2 Range of Services and Information Character The offering includes information sections such as News, Guide and Basic Knowledge, interactive calculators, as well as the display of market data (interest rates) and fee-based consulting (non-exhaustive list). The editorial content is prepared using state-of-the-art technological tools and serves general information purposes. It does not constitute investment, legal, or tax advice. Calculator results are non-binding reference values.

Art. 3 Market Data (Swap Rates) and Third-Party Licenses

The published swap rates are based on data from third-party providers, for which the Operator pays license fees.

The user is only permitted to access this data for personal information purposes.

Strict prohibition of further use: Any form of systematic storage, commercial redistribution, or publication of the interest rate data is strictly prohibited. In case of violations, the Operator reserves the right to take legal action.

Art. 4 Fee-Based Consulting Consulting is provided independently, product-neutral, and exclusively for a fee. The Operator does not accept any retrocessions or commissions from financial institutions in the context of consulting. A consulting contract is only concluded by means of a separate agreement or booking.

Art. 5 Intellectual Property and Protective Measures All copyrights to texts, guidelines, and calculator logic remain with the Operator. The use of automated systems (bots, crawlers) to extract licensed data or content is expressly prohibited.

Art. 6 Disclaimer The Operator is only liable for damages caused by gross negligence or intent. No guarantee is given for the accuracy of the market data or for the availability of the website. The final decision on entering into a mortgage agreement lies solely with the user. The Operator does not assume any liability for the contents of external websites that are referred to via hyperlinks.

Art. 7 Data Protection, Law and Place of Jurisdiction Data processing is carried out in accordance with the Operator's privacy policy. Swiss law applies. Place of jurisdiction is the registered office of the company in St.Gallen.

Art. 8 Google Analytics or Other Statistical Services We sometimes use Google Analytics or comparable services on our websites. This is a service provided by third parties that may be based in any country in the world (in the case of Google Analytics, it is Google Ireland (located in Ireland), with Google Ireland relying on Google LLC (located in the USA) as a processor (both "Google"), www.google.com), which we use to measure and analyze the use of the website (not personally identified). Permanent cookies set by the service provider are also used for this purpose. We have configured the service so that Google shortens the IP addresses of visitors in Europe before forwarding to the USA, thus preventing them from being traced. We have disabled the settings "data sharing" and "signals." Although we can assume that the information we share with Google is not personal data for Google, it is possible that Google may use this data for its own purposes to infer the identity of visitors, create personal profiles, and link this data with the Google accounts of those individuals. If you have registered directly with the service provider, the provider also knows you. The processing of your personal data by the service provider is then the responsibility of the service provider and governed by its own privacy policy. The service provider only informs us how our respective website is used (without providing any personal information about you).
